These Terms of Use (“Terms”) govern your access to and use of the websites, products and services offered under the trade name Indexburg (the “Service”). Indexburg is a specialized digital technology project owned and operated by Nayaltex (نيال للاقمشة والمفروشات). By accessing or using the Service you agree to these Terms.

1. Who may use the Service

Indexburg is intended only for teachers and authorized teacher assistants (TAs). By registering you represent and warrant that you are a teacher, authorized teaching assistant, or authorized school staff. Guardians, parents and students may receive messages or reports but are not permitted to use teacher/assistant dashboard features.

2. Authority to provide student and guardian contact details

Teachers and TAs who record contact information for students or guardians in Indexburg represent and warrant that the contact details were willingly provided by the recipient (or the student's legal guardian) for the purpose of receiving school-related communications. Indexburg relies on teachers and TAs to obtain and record this consent.

3. Messaging, opt-out and WhatsApp

Reports and messages to students and guardians are delivered using WhatsApp Business API / Meta templates.

Opt-Out: Recipients may opt out of receiving messages at any time by replying "STOP" to any message or by using the provided WhatsApp interface buttons.

Managed Inbox: Replies may open a managed response window. Recipients will not see assistants’ personal phone numbers when Indexburg manages replies.

4. Services and integrations (Google API Disclosure)

The Service integrates with Google Classroom to synchronize courses, rosters, assignments and other information.

Limited Use Disclosure: Indexburg’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

5. Payment, Credits, and Refund Eligibility

Teachers purchase credits via the billing mechanism available in the Service. Credits are deducted when services are used (for example, when reports are sent).

Refund Eligibility: In accordance with Egyptian Consumer Protection standards, a user is eligible to request a refund only within 14 days of the original purchase date, provided that no credits from that specific purchase have been used/consumed.

Consumed Services: Once a user initiates a WhatsApp report, syncs classroom data, or sends a message to a student or guardian, the service is deemed "consumed." Consumed services and spent credits are strictly non-refundable.

Process: To request a refund within the 14-day window, contact info@indexburg.com with your transaction receipt.

6. Acceptable use

You must not: misuse the Service; record student/guardian details without consent; attempt to access other users’ data; or send content that violates law or WhatsApp policies. Breach of these rules may lead to immediate account termination.

7. Limitation of liability

If Indexburg’s gross negligence directly causes you verifiable loss, we accept responsibility for reasonable direct damages. However, Nayaltex (نيال للاقمشة والمفروشات) / Indexburg will not be liable for indirect, incidental, or consequential damages.

8. Governing law and disputes

These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute shall be subject to the competent courts of Egypt.
